Terms of Use

Article I. Introductory Provisions

These Terms of Use of the PopStats application govern the legal relationship between Dakoty Studio, with its registered office at Čierny Brod 5, 925 08 Čierny Brod, Slovakia ("PopStats" or the "Company"), and the user ("User") regarding the use of the PopStats mobile application and related services ("Application" and "Services").

These Terms of Use constitute a legally binding agreement between the User and PopStats. By accessing or using the Application, creating an account, or using any of the Services, the User agrees to be bound by these Terms of Use. If the User does not agree with any part of these Terms of Use, they must not use the Application or Services.

Each use of the Application is governed by these Terms of Use. The Application may only be used by a person who has the legal capacity to enter into a binding agreement and who is at least 13 years old.

Article II. Registration and Account

To access certain features of the Application, the User must create an account ("Account") via the Application. The User agrees to provide complete, accurate, current, and truthful information during registration and to keep such information updated. Each User may only create and maintain one Account.

The User is solely responsible for safeguarding their login credentials and for all activities conducted through their Account. The User must immediately notify PopStats of any unauthorized access or suspected security breach. PopStats is not responsible for any loss or damage resulting from unauthorized use of the User's Account.

Article III. Nature of the Services

PopStats provides informational and analytical services, including charts, rankings, statistics, trend indicators, and related analytical visualizations.

The Services are provided for informational purposes only.

• Data may be delayed, estimated, incomplete, or inaccurate
• Rankings, scores, and trends are illustrative and informational only
• PopStats does not guarantee accuracy, completeness, or real-world outcomes
• Data should not be relied upon as professional, financial, business, or strategic advice
• Use of the Services is at the User's own risk

Article IV. Rights and Obligations of the User

The User agrees to use the Application in compliance with these Terms of Use and applicable laws. The User may not, directly or indirectly:

• Use the Application for unlawful purposes
• Attempt to interfere with or disrupt the Application or its infrastructure
• Attempt unauthorized access to systems or data
• Scrape, extract, copy, or reuse data from the Application for commercial purposes
• Reverse engineer, decompile, modify, or attempt to derive the source code
• Circumvent subscription, ad display, or access limitations
• Misrepresent identity or impersonate others
• Use automated systems that overload or abuse the Application

The User acknowledges that the Application is intended solely for personal, non-commercial use, unless explicitly permitted by PopStats.

Article V. Intellectual Property and License

All intellectual property rights related to the Application, including software, design, data compilation, trademarks, logos, and visual elements, are the exclusive property of PopStats or its licensors.

PopStats grants the User a limited, non-exclusive, non-transferable, revocable license to use the Application for personal, non-commercial purposes in accordance with these Terms of Use.

The User may not copy, distribute, modify, sell, sublicense, or exploit any part of the Application without prior written consent from PopStats.

Article VI. User Profiles and Data Saving

The Application allows Users to create profiles and save statistics, preferences, or tracked data for personal reference. PopStats does not claim ownership over User profile information but retains the right to process such data solely for the operation and improvement of the Services, in accordance with applicable data protection laws.

Users cannot upload public posts, comments, or other user-generated content visible to other Users.

Article VII. Premium Services and Advertising

Premium Services

PopStats offers optional paid subscriptions ("Premium Services") that provide enhanced features, expanded analytics, or reduced advertising. PopStats reserves the right to modify, update, or discontinue Premium features at its discretion.

Subscription and Payment

Premium subscriptions are billed on a monthly or yearly basis and renew automatically unless canceled before the end of the current billing period. Payment is processed through the Apple App Store or Google Play Store, according to their respective terms.

Cancellation

Subscriptions may be managed and canceled through the User's App Store or Google Play account settings. Cancellation takes effect at the end of the current billing cycle.

Advertising

The free version of the Application contains advertisements. Certain Premium tiers may reduce or remove ads, but PopStats does not guarantee complete removal of all promotional content.

Article VIII. Availability and Technical Requirements

PopStats does not guarantee uninterrupted availability of the Application. The Application may be temporarily unavailable due to maintenance, updates, or technical issues. The User acknowledges that such interruptions do not constitute a breach of these Terms.

The User is responsible for ensuring device compatibility. The Application is available for supported iOS and Android devices only.

Article IX. Changes to the Application and Terms

PopStats reserves the right to modify, update, suspend, or discontinue any part of the Application or Services at any time. Material changes to these Terms of Use will be communicated in advance where required by law. Continued use of the Application after changes take effect constitutes acceptance of the updated Terms of Use.

Article X. Liability Disclaimer

The Application and Services are provided "as is" and "as available", without warranties of any kind. To the maximum extent permitted by law, PopStats disclaims all warranties, express or implied, including accuracy, reliability, availability, or fitness for a particular purpose.

PopStats shall not be liable for:

• Inaccurate, delayed, or incomplete data
• Decisions or actions taken based on Application data
• Loss of profits, data, or business opportunities
• Indirect, incidental, or consequential damages

The User bears full responsibility for their use of the Application and any reliance on provided information.

Article XI. Termination

PopStats reserves the right to suspend or terminate the User's Account at any time in case of violation of these Terms of Use or misuse of the Application. Termination does not affect any rights or obligations accrued prior to termination.

Article XII. Final Provisions

Failure to enforce any provision shall not constitute a waiver of rights. The User may not assign their rights or obligations under these Terms of Use.

Governing Law: These Terms of Use shall be governed by the laws of Slovakia.

Jurisdiction: Any disputes shall be resolved by the competent courts of the Slovak Republic.

Language: These Terms of Use are binding in the English language. Translations are provided for informational purposes only.

Severability: If any provision is held invalid, the remaining provisions shall remain in full force and effect.

Effective Date: These Terms of Use enter into force on 22.12.2025.
